On 10 June, 2019, associate professor Xu Xiao and four postgraduates, Ma Wenfei, Wang Huiru, Wu Shengnan and Yang Jinhui was invited to the Annual Graduate Conference 2019 held by Institution of Commercial and Company Law (ICCL) in Durham University School of Law. The conference attracted doctoral students and young scholars from all over the world, including Durham University, Central European University, University of London, the University of Manchester, University of Bologna and Jilin University. The conference was themed at Commercial Law: New Challenges and Opportunities, which was divided into seven sub-forums: Issues of Privacy and Information, Company Law, Competition Law, Environmental Law, Cross-border Issues, Corporate Governance and Management, EU Laws and Contract Law.
The conference began with Prof. John Linarelli’s welcome speech and he is a member of the Department of Commercial Law, Durham University. In the afternoon, our four students gave English reports in the sub-forum of Commercial Law and Environmental Law.
Wu Shengnan reported on The Improvement of Chinese Shareholder Oppression Remedy: Lessons from the Unfair Prejudice Remedy in the UK. Approached from the importance of shareholders’ oppression, she gave a brief introduction of relative regulations on protection of shareholders’ interests in China, shared experience from company law in the UK and proposed advice to improve relevant articles in Chinese company law.
Yang Jinhui reported on Hard Decisions: China Faces Though Choices in Capital Market Reform. From the perspective of theoretical discussion and empirical contradiction about differentiated voting, Yang introduced the reform of Sci-Tech innovation board and put forward feasible suggestions on listing rules by comparing institutions at home and abroad.
Wang Huiru reported on Accountability of Transnational Corporations under International Rule of Law: Retrospect and Prospect. With introduction of the asymmetry between rights, interests and obligations, responsibilities of international companies in the framework of International Law, Wang analyzed the obstacles of victim international companies to obtain juridical remedies, criticized the limitation of state-centered responsibility and international soft laws, explored the development and contradictories about the mechanism of treaty proposal and looked into the future development of international law.
Ma Wenfei reported on Greening the Belt and Road Initiative. Ma introduced the historical background and the influence of the Belt and Road Initiative, illustrated China’s concept of green development and China’s position in green development. Her report showed that the green development of the Belt and Road has become an important component in constructing a community with shared future of mankind.
